Financial Times – Battle Over Ethical Brand -

The Financial Times article entitled ‘Battle Over Ethical Brand’ reported on the latest progress of the fight between So Organic and Sainsbury’s PLC, regarding the So Organic name. Jonathan Moules of the FT wrote ‘Ms Burlton first registered So Organic as a trademark in early 2005 when she started selling ethically produced cosmetics, deodorants and soaps online... her business has since extended into a range of non-food products, including recycled stationery, CDs and books, which Ms Burlton now sells both online and from a shop in Greenwich market. Sainsbury's issued its own trademark application for So Organic in January 2006, covering a much wider range of goods than food and drink, including many items that Ms Burlton now stocks.’ So Organic comments: Samantha Burlton and the So Organic Directors have stated that they will do everything legally to stop the So Organic name being trademarked by Sainsbury’s. Previous public statements by Sainsbury’s have said that they will only use the form ‘Sainsbury’s SO Organic’, and only with food. The current attempt to trademark many other products, and the So Organic name only, is in direct contradiction to this.
